Please read these terms carefully. By accessing or using DockCrew, creating a profile, submitting your information, or booking any services through the platform, you agree to be bound by these Terms of Service and Privacy Policy in their entirety.

1. DockCrew as a Marketplace

DockCrew is a technology platform and online marketplace that connects employers (captains, vessel owners, marina managers, and others seeking marine professionals services) with independent workers (deckhands, stews, chefs, washdown crews, and other marine day workers). DockCrew does not provide marine professionals services directly.

DockCrew is not an employer, staffing agency, temp agency, employment agency, or joint employer of any worker listed on the platform. DockCrew has no control over, and is not responsible for, the quality, timing, legality, safety, or any other aspect of the services provided by workers through the platform.

Any agreement for services is solely between the employer and the worker. DockCrew is not a party to such agreements and accepts no responsibility or liability arising from them.

2. Independent Contractor Relationship

All workers who register on DockCrew are independent contractors, not employees of DockCrew or of any employer who books them through the platform. Nothing in these Terms or in the operation of the platform creates or implies any employment, agency, partnership, joint venture, or franchise relationship between DockCrew and any user.

3. Eligibility & Account Registration

To use DockCrew you must be at least 18 years of age and legally able to enter into binding contracts under applicable law. By using the platform you represent and warrant that you meet these requirements.

You agree to provide accurate, current, and complete information when registering. DockCrew reserves the right to verify any information you provide and to suspend or terminate your account if information is found to be false, misleading, or incomplete.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify DockCrew immediately at [email protected] if you suspect unauthorized access to your account.

4. Worker Terms

4.1 Profile Accuracy

Workers represent and warrant that all information in their profile — including qualifications, certifications, licenses, experience, and availability — is accurate and up to date. DockCrew may remove or suspend any profile that contains false or misleading information.

4.2 Verification

DockCrew may require workers to submit identity verification documents, background check authorizations, and other credentials. Approval on the platform is at DockCrew's sole discretion. Verification by DockCrew does not constitute an endorsement or guarantee of any worker's skills, suitability, or fitness for any particular job.

4.3 Ratings & Reviews

Workers acknowledge that verified employers may submit ratings and reviews of their work. DockCrew reserves the right to remove profiles with consistently low ratings at its sole discretion. Workers may not offer incentives for positive reviews or retaliate against employers for negative reviews.

4.4 Safety & Conduct

Workers agree to conduct themselves professionally, follow all safety protocols, and comply with reasonable instructions from employers while on assignment. Workers acknowledge that marine environments carry inherent risks and accept responsibility for their own safety decisions.

5. Employer Terms

5.1 Due Diligence

Employers are solely responsible for conducting their own due diligence before hiring any worker through the platform, including but not limited to verifying credentials, licenses, insurance, and suitability for the specific work. DockCrew's verification process does not replace or substitute for an employer's own assessment.

5.2 Working Conditions

Employers agree to provide a safe working environment, clearly communicate job requirements and expectations, and comply with all applicable labor, safety, and maritime laws in the jurisdiction where work is performed.

5.3 Payment Obligation

Employers are obligated to pay workers the agreed rate for all work completed. Failure to pay is a material breach of these Terms and may result in account suspension and referral to applicable authorities.

5.4 No Re-listing

Employers may not use worker contact information obtained through DockCrew to solicit workers for engagements outside the platform for a period of 12 months following any booking. Circumventing the platform to avoid fees constitutes a material breach of these Terms.

6. Payments & Fees

DockCrew charges service fees to both employers and workers as disclosed in the platform. Fee structures for founding members and standard users are as described on the DockCrew website at the time of sign-up and are subject to change with reasonable notice.

For card payments, funds are processed through a secure third-party payment processor (Stripe). DockCrew does not store payment card information. By initiating a payment you agree to Stripe's terms of service.

For cash payments marked through the platform, a fixed platform fee applies to the employer. Workers and employers are solely responsible for any tax reporting obligations associated with cash transactions.

All fees are non-refundable except as required by applicable law or as DockCrew determines in its sole discretion on a case-by-case basis.

7. Limitation of Liability & Disclaimers

READ THIS SECTION CAREFULLY. IT LIMITS DOCKCREW'S LIABILITY TO YOU.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

DOCKCREW DOES NOT WARRANT THAT:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DOCKCREW AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY:

IN NO EVENT SHALL DOCKCREW'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE PLATFORM EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO DOCKCREW IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential or incidental damages. In such jurisdictions, DockCrew's liability is limited to the fullest extent permitted by law.

8. Indemnification

You agree to defend, indemnify, and hold harmless DockCrew, its affiliates, officers, directors, employees, agents, and successors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorneys' fees) arising from:

9. Disputes Between Users

DockCrew is not responsible for disputes between employers and workers. If a dispute arises, DockCrew may, at its sole discretion, provide information to assist in resolving the dispute but is under no obligation to do so.

Users release DockCrew from any claims, demands, and damages arising from or related to any dispute with another user. Users agree to resolve disputes directly with each other and to hold DockCrew harmless from all such disputes.

11. Termination

DockCrew reserves the right to suspend or terminate your account and access to the platform at any time, with or without cause, and with or without notice, at its sole discretion. Grounds for termination include, but are not limited to, violation of these Terms, fraudulent activity, consistently low ratings, or inactivity.

Upon termination, your right to use the platform immediately ceases. DockCrew may retain your data as required by law or for legitimate business purposes.

You may terminate your account at any time by contacting [email protected]. Termination does not relieve you of any obligations incurred prior to termination.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to its conflict of law provisions, except where mandatory consumer protection laws in your jurisdiction provide otherwise.

Any dispute arising from these Terms or your use of the platform shall first be submitted to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA), conducted remotely or in Cheyenne, Wyoming, United States, in the English language. The arbitrator's decision shall be final and binding.

Notwithstanding the foregoing, either party may seek emergency injunctive or equitable relief in any court of competent jurisdiction to prevent irreparable harm.

Class action waiver: You agree that any dispute resolution will be conducted on an individual basis and not as a class action, collective action, or representative proceeding.

EU/UK residents have additional rights under GDPR/UK GDPR. California residents have rights under CCPA. We honor these rights regardless of your location where reasonably practicable.

We implement industry-standard technical and organizational measures to protect your data. However, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security.

13.7 Children's Privacy

DockCrew is not directed at persons under 18. We do not knowingly collect personal information from minors. If we become aware that we have collected data from a person under 18, we will delete it promptly.

13.8 International Transfers

Your data may be processed in countries other than your own, including the United States. By using the platform you consent to such transfers. We ensure appropriate safeguards are in place for international transfers where required by law.

DockCrew uses cookies and similar tracking technologies to operate the platform and understand usage patterns.

14.1 Essential Cookies

These are necessary for the platform to function and cannot be disabled. They include session management and security cookies. No consent is required for these.

14.2 Analytics Cookies

We use Google Analytics to collect anonymized data about how visitors use DockCrew — pages visited, time on site, traffic sources. This data helps us improve the platform. Google Analytics sets cookies on your device. You can opt out at any time using the cookie preference center on the site or via the Google Analytics Opt-out Browser Add-on.

14.3 Your Cookie Choices

When you first visit DockCrew, you will be shown a cookie consent banner. You may accept or decline analytics cookies at that time. You can change your preferences at any time. Declining analytics cookies will not affect your ability to use the platform.

15. Changes to These Terms

DockCrew reserves the right to modify these Terms at any time. We will notify registered users of material changes by email and will update the "Last updated" date at the top of this page. Your continued use of the platform after the effective date of changes constitutes acceptance of the revised Terms.

If you do not agree to the revised Terms, you must stop using the platform and may request deletion of your account.
